No, Childcare Is Not a Business Expense
Childcare costs — nursery fees, childminder fees, after-school clubs, babysitters — are not allowable business expenses for sole traders. HMRC classifies childcare as a personal expense because caring for your children is a personal responsibility, not a cost of running your trade.
This applies regardless of the circumstances. Even if you need childcare specifically to be able to work, the cost is personal.
Why Not?
The reasoning follows the same logic as other personal costs: everyone with children needs childcare arrangements, whether they're self-employed, employed, or not working. The expense isn't incurred "wholly and exclusively" for business purposes — it exists because you have children, not because you have a business.
The case of Halstead v Condon (1970) established this principle, and HMRC has maintained it consistently since.
Government Help With Childcare
Although childcare isn't tax-deductible, several government schemes help reduce the cost:
Tax-Free Childcare. For every £8 you pay in, the government adds £2 — up to £2,000 per child per year (£4,000 for disabled children). Available to self-employed parents earning at least the National Minimum Wage equivalent and less than £100,000 per year.
30 hours free childcare. Working parents of 3-4 year olds can get 30 hours of free childcare per week during term time. Self-employed parents qualify if they earn at least the equivalent of 16 hours at the National Minimum Wage.
Universal Credit childcare element. If you receive Universal Credit, you can claim back up to 85% of childcare costs, up to £1,014.63 per month for one child or £1,739.37 for two or more.
Free early education. All 3-4 year olds get 15 hours of free early education per week. From 2024, this expanded to include younger children as well.
Employing a Nanny Through Your Business
Even if you employ a nanny and put them on your business payroll, the childcare element of their work is not deductible. If the nanny also does genuine business work (cleaning your business premises, for example), only the business portion of their wages is allowable.
The Practical Takeaway
